Civil Case Results: A Proud History Of Verdicts And Settlements

I am known for taking cases as far as necessary to reach the goals of my clients. I will never shy away from the possibility of fighting for your rights either before a claim is filed or in court. $3.25 Million – Jury Verdict

Medical Malpractice. Failure to diagnose cancer which caused increased risk of future cancer recurrence to client.

Insurance Bad Faith / Motor Vehicle Negligence. Defendant’s insurance company failed to appropriately value the damages resulting from a motor vehicle wreck prior to the jury trial. Following the jury verdict in favor of the Clients, the insurance company agreed to settle the case in excess of Defendant’s policy limits during a post-verdict mediation.

$2.5 Million – Jury Verdict

Medical Malpractice. Client received permanent nerve damage during a blood draw before hand surgery. Client developed Chronic Regional Pain Syndrome. As a result, Client had to have wiring implanted into his spinal cord to control pain. The insurance company, through its defense team, arrogantly bragged that it would never be found negligent nor be ordered to pay a penny on the case. They were wrong. The $2.5 million dollar jury verdict that resulted in Client’s favor after a 4-day jury trial appears to be an Indiana record for this type of injury.

$850,000.00 – Settlement

Medical Malpractice. Physician negligently failed to treat a pregnancy induced hypertension and failed to properly deliver a full-term infant with fetal heart problems, which tragically resulted in the infant’s death.

$748,000 – Settlement

Semi-Truck Negligence / Wrongful Death. A semi-truck driver hauling grain carelessly crossed the center line on a highway and collided head-on with the Client’s father’s vehicle. The father sustained catastrophic injuries and died shortly after being flown via helicopter to a hospital. The case settled for semi-truck’s policy liability limits of $750,000, but $2,000 of that amount was paid to another party who sustained property damage.

$685,000.00 – Settlement

Motor Vehicle Negligence. Defendant’s vehicle crossed the center line on a highway and crashed head-on into Client’s vehicle. Client sustained serious injuries and a metal rod was surgically implanted in her left femur. Client also sustained significant injury to her ankle. Client was unable to walk for a lengthy period of time.

$500,000.00 – Settlement

Medical Malpractice. Physician and large Chicago hospital negligently failed to treat an iatrogenic injury to the left vagus nerve.

$450,000.00 – Settlement

Motor Vehicle Negligence. Defendant’s vehicle rear-ended the Client’s vehicle. Client sustained back and neck injuries which required surgery. The case settled in excess of Defendant’s policy limits on the eve of trial.

$355,000 – Settlement

Motor Vehicle Negligence. Defendant’s vehicle negligently crossed the center-line on a highway to avoid striking an animal and collided head-on with Client’s husband’s vehicle. Obtained insurance policy limits as settlement.

$326,459.40 – Settlement

Wrongful Death. Client’s father was fatally shot by an employee of a bar during a fight, which involved difficult liability.

$325,000 – Settlement

Motor Vehicle Negligence.  Defendant’s vehicle collided with Client as he rode his motorcycle.  Client sustained serious leg injury and scaring.

Dog Bite. The 3-year old Client visited a family gathering where she was attacked by a dog of German Shepard / Pit-Bull mix. The attack resulted in a puncture wound to the Client’s left cheek, laceration on the inside of her upper lip, lacerations around her eyelids, a fractured eye socket, and a broken nose.

$275,000.00 – Settlement

Semi-Truck Negligence. A semi-truck driver carelessly disregarded a red light and collided with Client’s vehicle, which resulted in the death of Client’s infant who was riding as a backseat passenger in the vehicle.

$250,000.00 – Settlement

Motor Vehicle Negligence. Defendant’s vehicle failed to stop at a stop sign and collided with vehicle that Client rode in as a passenger. Client sustained neck injuries that required surgery. The case settled for Defendant’s policy limits and also Client’s policy limits under her underinsured motorist coverage.

$170,000.00 – Settlement

Dog Bite. A 9-year old child suffered severe facial injuries when attacked by a neighbor’s large dog. The neighbor negligently failed to properly confine the dog. The child required surgery and extensive mental health counseling due to the savage nature of the attack.

$150,000.00 -Settlement

Motor Vehicle Negligence. Client was walking across a street when struck by Defendant’s vehicle. Client suffered injury to leg which required surgery.

$126,000.00 – Settlement

Motor Vehicle Negligence. Clients were riding on a moped when struck by Defendant’s vehicle after disregarding a stop sign. Both clients suffered injury, and one Client required surgery to leg.

$108,834.46 – Settlement

Motor Vehicle Negligence. Client was riding as a passenger in the backseat of a vehicle. The driver disregarded a stop sign and collided with another vehicle. Client sustained head and other injuries.

$108,193.62 – Settlement

Motor Vehicle Negligence. Client and her son were stopped in traffic when they were rear-ended by an intoxicated driver. Client was flown via helicopter to hospital with various injuries, but son suffered only minor injuries.

$100,000.00 – Settlement

Motor Vehicle Negligence. Client had right-of-way on roadway and Defendant disregarded stop sign and collided with Client’s vehicle. The collision caused both vehicles to travel a notable distance off the roadway. Client sustained head injury she has experienced tremors, difficulty with vision, fatigue, balance problems, and dizzy spells.

$100,000.00 – Settlement

Motor Vehicle Negligence. Defendant failed to yield right-of-way and collided with Client while riding a motorcycle. Client sustained head injury. The case settled for Defendant’s policy limits.

Motor Vehicle Negligence. Defendant’s vehicle forcefully rear-ended Client’s vehicle while Client had been fully stopped in traffic at a light. Client sustained injury to her neck and back areas and she underwent a cervical diskectomy surgery.

Motor Vehicle Negligence. Defendant disregarded a stop sign and collided with Client’s vehicle in a rural area. Client suffered significant injury to his head and abdomen.

Motor Vehicle Negligence. Defendant’s vehicle slid on ice due to excessive speed and rear-ended Client’s vehicle. Client suffered head injury.

Wrongful Death / Police Misconduct. Client’s father was suicidal and refused to come out of his home. Police and negotiators attempted to convince the father to exist the home. Father exited the home, but police snipers fatally shot him. The parties settled the case at mediation pursuant to a confidential settlement agreement

Legal Malpractice. An attorney handling Client’s criminal case negligently failed to conduct an investigation and misrepresented matters during plea negotiations. Client pled guilty to Dealing in Cocaine (Class A felony) and received a 30-year sentence. Attorney Barrett then became involved and filed a petition for post-conviction relief based and argued ineffective assistance of counsel regarding Client’s original attorney. The court granted the petition and vacated the Client’s conviction and entire 30-year sentence. Thereafter, a legal malpractice claim was brought against the original attorney, which quickly resulted in a confidential settlement.

Medical Malpractice. A physician and hospital negligently failed to control the Client’s elevated blood pressure during pregnancy, which resulted in the tragic death of the Client’s full-term child. The physician and hospital settled the case pursuant to a confidential settlement agreement.

Medical Malpractice. A nurse at a hospital negligently tore through all three layers of the infant Client’s skin on Client’s face during the removal of medical tape. The injury left the Client with a permanent scar and emotional damages. The hospital settled the case pursuant to a confidential settlement agreement.

Sexual Battery. Defendant was a physician who sexually battered Client during the Client’s routine breast examination. The battery involved the fondling of Client’s breasts for sexual gratification and kissing Client. The case was settled out-of-court pursuant to a confidential settlement agreement.

Employment Discrimination/Breach of Contract. Defendant was a city that wrongfully forced its employee, Client, to resign his position as a police officer. The parties resolved the case by entering into a confidential settlement agreement.

Police Misconduct. Defendant was a police officer who illegally searched Client and found a small amount of marijuana in Client’s pocket. Criminal charges were filed against Client. The court determined the police officer violated Client’s constitutional rights and suppressed the evidence. As a result, the prosecutor dismissed the entire case. Client then filed a civil rights case against the police officer and the case quickly settled for a confidential amount of money.

Police Misconduct. Defendant was a police officer and maliciously battered Client during the investigation of an underage drinking party. Client filed a civil rights case against the police officer. The parties settled the case pursuant to a confidential settlement agreement.

Defendant was a police officer who battered Client when Client arrived home and found police inside his residence without a warrant and questioning Client’s son about underage drinking. Client filed a civil rights case against the police officer. The parties settled the case pursuant to a confidential settlement agreement.

Insurance Bad Faith. The defendant was an insurance company that wrongfully cancelled Client’s life insurance policy after 26 years. The case settled at mediation pursuant to a confidential settlement agreement.

Insurance Bad Faith. Client had entered into an agreement with her life insurance company which provided that Client would no longer need to pay premiums if she became totally disabled. Client became totally disabled, but the insurance company wrongfully refused to honor the agreement. Client filed a lawsuit against the insurance company and the case settled pursuant to the terms of a confidential settlement agreement.

Police Misconduct. Client visited the home of a police officer to collect information regarding the officer’s mortgage. The police officer was several months behind in his mortgage payments. The police officer refused to cooperate and called other police officers by falsely claiming Client had trespassed. The prosecutor filed a trespass charge against Client, but later dismissed the case. Thereafter, Client filed a civil rights lawsuit against the police officer. The parties settled the case pursuant to a confidential settlement agreement.
